PERSONAL INFORMATION

Personal information is any factual or subjective information, recorded or not, about an identifiable client. We collect personal information by fair and lawful means as we are required to do so by the Law Society of Saskatchewan.

We usually collect your personal information directly from you, at the start of a retainer and in the course of our representation or from third party sources such as your accountant, employer, realtor or someone holding a power of attorney over your estate. If any changes occur to your personal information (for instance, a change of address) we would appreciate being advised of the same.

In most cases, we shall ask you to specifically consent, if we collect, use, or disclose your personal information. Normally, we ask for your consent in writing, but in some circumstances, we may accept your oral consent. Sometimes, your consent may be implied through your conduct with us.

We do not disclose your personal information to any third party to enable them to market their products and services. For example, we do not provide our client mailing lists to other law firms.

INFORMATION RETENTION AND DESTRUCTION

Upon conclusion of the work for which your personal information was collected, and payment of the account your file will be closed. Consistent with time limitation requirements under the law, and recommendations from our professional organizations and associations pertaining to the retention of files, your file will be retained in a secure setting until destroyed.

Generally all files will be destroyed after five years, except for Real Estate files which are destroyed after three years from the date of last work.

We take all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification or disclosure.

ACCESS TO PERSONAL INFORMATION

You may ask your lawyer for access to any personal information we hold about you. If that is not satisfactory you may contact the firm privacy officer. If we hold information about you and you can establish that it is not accurate, complete and up-to-date, we will take reasonable steps to correct it. If the information cannot be changed, your request and our decision will be noted in the file.

We will endeavour to provide you with access to your personal information. However, in certain circumstances it may not be possible. In any case where we are unable to or cannot grant you access to personal information we will provide you with reasons on request, ie:

• Information that is prohibitively costly to provide;

• Information that has been destroyed;

• Information that contains personal information about a third party or is protected by solicitor client privilege, or would reveal confidential commercial information, and which cannot be severed from disclosure;

• For other legal and security reasons which relate to the enforcement of any law of Saskatchewan or Canada.

E-MAIL COMMUNICATION AND WEBSITE

You should be aware that e-mail and cell phone communications are not 100% secure mediums, and you should be aware of this when contacting us to send personal or confidential information.

We want you to be aware that our website contains links to other sites, which are not governed by this privacy policy.

CHANGES TO THIS PRIVACY POLICY

Since we regularly review all of our policies and procedures, we may change our Privacy Policy from time to time.
